Saginaw Valley State University (SVSU) Drone Use Policy 5.2-8
1. Purpose
This policy establishes regulations for the operation of Unmanned Aircraft Systems (UAS), commonly known as drones, to ensure the safety, privacy, and security of the SVSU community and property.
2. Scope
This policy applies to all individuals, including students, faculty, staff, contractors, and visitors, who wish to operate drones on or above SVSU property.
3. General Policy
- The operation, takeoff, or landing of drones shall not create a hazard to University-owned property, the University community, or the public at any time. UAS may not be operated in a way that disrupts instruction or unduly affects the environment of people in, or passing through, a common space, those working or studying within a building, or those entering, exiting or otherwise making their way about a facility.
- UA may not be operated inside university buildings unless written permission is received from the Office of Administration and Business Affairs (ABA).
- Authorized drone operations without prior authorization are permitted for:
- SVSU Police Department: For law enforcement and emergency response.
- University Communications: For official university marketing, photography, and videography.
- Academic and Research Activities: Conducted by SVSU faculty, staff, or students as part of university-sanctioned programs.
- Approval for Other Uses: Any other drone operations by outside companies for commercial or news gathering purposes must receive prior written approval from the Office of Administration and Business Affairs (ABA).
4. Approval Process
- Request Submission: Individuals or entities seeking approval must submit a detailed request at least 24 hours prior to the intended operation date. The request should include:
- Purpose of the drone operation.
- Date, time, and specific location of the flight.
- Equipment specifications.
- Pilot credentials, including FAA certifications.
- Proof of liability insurance, naming SVSU as an additional insured party.
- Review Authority: The Office of Administration and Business Affairs (ABA) is responsible for reviewing and approving drone operation requests. They will coordinate with relevant departments to assess safety, privacy, and compliance considerations.
5. Operational Requirements
Approved drone operations must adhere to the following:
- Compliance: All operations must comply with FAA regulations, state and local laws, and SVSU policies.
- Pilot Certification: Operators must possess a valid FAA Part 107 Remote Pilot Certificate.
- Insurance: Operators must maintain liability insurance with a minimum coverage of $2 million, naming SVSU as an additional insured.
- Flight Restrictions for all operations:
- Drones must not fly over people, stadiums, or during events without explicit permission.
- Operations are restricted to daylight hours unless a night operation waiver is obtained.
- Drones must remain within the visual line of sight of the operator at all times.
- Privacy: Operators must avoid capturing images or data in areas where there is a reasonable expectation of privacy, such as residence halls, restrooms, and private offices.
6. Enforcement
- Violations: Unauthorized or careless drone operations may result in:
- Immediate cessation of the flight.
- Confiscation of equipment.
- Referral to campus, local, state or federal law enforcement for action consistent with federal and state law.
- Legal action, including trespassing charges and fines.
7. Policy Review
This policy will be reviewed annually by the Office of Administration and Business Affairs (ABA) to ensure compliance with evolving laws and technologies.
